Ministry of Transport and Communications submits a draft law on the transit of Belarusian fertilisers via Lithuania

In solidarity with the US sanctions and seeking to put a rapid stop on the transit of Belarusian fertilisers through Lithuania, the Ministry of Transport and Communications submits for coordination to the ministries and institutions a draft law on the application and implementation of economic and other sanctions on the Republic of Belarus necessary for ensuring national security. This law would help to solve the problems of introducing legal sanctions in Lithuania on the basis of an assessment of threats to national security.

The draft law seeks to adequately safeguard the legitimate interests of Lithuania as a transit state and the interests of public security, which are currently vulnerable to hybrid aggression by the third state against the Republic of Lithuania. In order to protect these interests, it is necessary to apply and implement not only the restrictive measures and international sanctions imposed by the Common Security and Foreign Policy of the European Union in accordance with the international obligations of the Republic of Lithuania, but also to establish that sanctions applicable in Lithuania are imposed on the Belarusian entities and/or direct or indirect Belarusian importers, buyers or transferrers of products of Belarusian or non-Belarusian origin.

The proposed law would stipulate that transactions concluded before the implementation of sanctions in Lithuania must be terminated immediately unilaterally or by agreement of the parties or their execution must be suspended for the period of implementation of sanctions. It would also be prohibited to conclude new transactions, the execution of which would contradict the sanctions implemented in Lithuania.

It is envisaged that the implementation of sanctions will be determined and amended by the resolutions of the Government of the Republic of Lithuania. The Government resolution would determine the what actions Lithuanian natural and legal persons must perform when executing sanctions, or what actions are prohibited.

In order to promptly ensure the legitimate and national security interests of the Republic of Lithuania as a transit state, including the suspension of the transit of Belarusian fertilisers via the territory of the country, legislative proposals will be submitted to the Seimas for consideration as a matter of extreme urgency.
